Privacy Policy NoticeAs of June 27, 2001

PURPOSE OF THIS NOTICE

Title V of the Gramm-Leach-Bliley Act (GLBA) generally prohibits any financial institution, directly or through its affiliates, from sharing nonpublic personal information about you with a nonaffiliated third party unless the institution provides you with a notice of its privacy policies and practices, such as the type of information that it collects about you and the categories of persons or entities to whom it may be disclosed. In compliance with GLBA, we are providing you with this document, which notifies you of the privacy policies and practices of Harris Insurance Inc.

The GLBA further requires that we inform you that you have a right to prevent us from sharing nonpublic personal information about you with a nonaffiliated third party for any purpose that is not specifically authorized by law. Your right to prevent us from sharing nonpublic personal information about you with a nonaffiliated third party for a purpose that is not specifically authorized by law is called your right to "opt-out" of such information sharing.

OUR PRIVACY POLICIES AND PRACTICES

In order to provide insurance products and services that respond to our customers' diverse needs, at Harris Insurance Inc. we maintain the confidentiality of our customer's personal information is of the highest importance. Harris Insurance Inc. personal information-handling practicesare governed by this privacy policy and are further regulated by law. This notice describes those practices and how they preserve your privacy in a way that permits Harris Insurance Inc. to provide you with the products and service you demand.

INFORMATION WE COLLECT

In the course of our business relationship with you, we collect information about you that is necessary to provide you with our products and services. We may collect certain nonpublic personal information when underwriting, administering or servicing an insurance policy, or in handling a claim. We get most of our information directly from you. The application you complete, as well as any additional information you provide, generally gives us most of the information we need to know. Sometimes we may contact you by phone or mail to obtain additional information. Depending on the nature of your insurance transaction, we may need additional information about you or other potential insured's from outside sources such as but is not limited to an individual's name, address, telephone number, social security number, motor vehicle reports, policy number, loss information reports, credit reports, premium and/or premium payment history, court records, medical history or other public records. For property insurance, we may send someone to inspect your property and verify information about its value and condition, and a photo of the property may be taken. We also may obtain information from third parties such as other insurance companies or consumer reporting agencies.

INFORMATION WE MAY DISCLOSE TO THIRD PARTIES

We do not disclose any nonpublic personal information about our customers or former customers to anyone, except to other insurance companies (nonaffiliated third parties) that we represent, or except as permitted by law.

NON-AFFILIATED THIRD PARTIES TO WHOM DISCLOSURE MAY BE MADE

Harris Insurance Inc. does not disclose information about you to others unless the disclosure is necessary to conduct our business. By law, Harris Insurance Inc. is permitted to share information about you without prior permission under certain circumstances to certain persons and organizations such as:

  • Parties administering transactions as requested or authorized by you.
  • Lienholder, mortgagee, assignee, lessor or other person shown on our records as having legal or beneficial interest in a policy of insurance.
  • Parties who perform a business, professional or insurance function for our company.
  • Claim adjuster, appraisers, investigators and attorneys who need the information to investigate, defend or settle a claim involving you.
  • Insurance support organizations which are established to collect information for the purpose of detection and preventing insurance crimes and fraudulent claims.
  • Insurance regulatory agencies in connection with the regulation of our business.
  • Law enforcement or other governmental authorities to protect our legal interest or in cases of suspected fraud or illegal activities.
  • Parties acting in a fiduciary or representative capacity to you (attorney, accountants, and auditors).
  • Parties enforcing Harris Insurance Inc's rights in connection with the settlement of a debt, the transfer of interests or an audit.

OUR PRACTICES REGARDING INFORMATION CONFIDENTIALITY AND SECURITY

We restrict access to nonpublic personal information about you to those employees who need to know that information in order to provide products or services to you. We maintain physical, electronic and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.

OUR POLICY REGARDING DISPUTE RESOLUTION

Any controversy or claim arising out of or relating to our privacy policy, or the breach thereof, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

RESERVATION OF THE RIGHT TO DISCLOSE INFORMATION IN UNFORSEEN CIRCUMSTANCES

In connection with the potential sale or transfer of its interest, Harris Insurance Inc. and its affiliates if any, reserves the right to sell or transfer your information (including but not limited to your address, name, age, sex, zip code, state and county of residency and other information that you provide through other communication) to a third party entity that (1) concentrates its business in a similar practice or service; (2) agrees to be Harris Insurance Inc. successor in interest with regard to the maintenance and protection of the information collected; and (3) agrees to the obligations of this privacy statement.
